First-Degree Robbery – California Penal Code § 212.5 PC
Defending Against First-Degree Robbery in Los Angeles
First-degree robbery under Penal Code 212.5 PC is one of the most seriously prosecuted felonies in California and one of the most aggressively charged by Los Angeles County prosecutors. It is a strike offense under California’s Three Strikes law meaning a conviction not only carries a state prison sentence of three to nine years but also permanently alters the consequences of any future felony conviction. The charge applies when a robbery occurs inside a residence, when the victim is a bus or taxi driver performing their duties, or when the victim has just used an ATM. A conviction carries state prison time, substantial fines, a strike on your record, and consequences that reach into every area of your life for years. At The Law Offices of Arash Hashemi our criminal defense attorney has spent over 20 years defending clients against serious felony charges including first-degree robbery throughout Los Angeles County. What Is First-Degree Robbery Under PC 212.5?
Robbery under California law is the taking of property from another person using force or fear. Penal Code 212.5 elevates a robbery to first degree when the crime occurs under specific aggravating circumstances. All other robberies are second-degree offenses carrying lesser sentences. The statute has two subsections that define when first-degree treatment applies:
PC 212.5(a) — Home Invasion Robbery:
A robbery committed inside an inhabited dwelling including a house, apartment, or any structure where people live even if no one is home at the time. This is the most commonly charged form of first-degree robbery in Los Angeles and it carries the most serious sentencing exposure. Multiple victim enhancements apply when more than one person is present in the residence.
PC 212.5(c) — Transportation and ATM Robbery:
A robbery committed against a driver or passenger of any bus, taxi, streetcar, cable car, subway, or similar vehicle for hire, or against any person who has just completed a transaction at an ATM. This subsection targets robberies in specific public settings where victims are particularly vulnerable and it carries the same prison sentence as home invasion robbery.
What the Prosecution Must Prove to Convict You of First-Degree Robbery
To secure a conviction under PC 212.5 the prosecution must prove all four elements of robbery beyond a reasonable doubt plus the specific circumstance that elevates it to first degree:
- You took property that belonged to someone else
- The property was taken from the victim’s person or immediate presence
- You used force or fear to take the property or to prevent the victim from resisting
- You intended to permanently deprive the owner of the property
- The robbery occurred in an inhabited dwelling, on a vehicle for hire, or immediately following an ATM transaction
The prosecution must prove every one of these elements. If any element cannot be established beyond a reasonable doubt the charge cannot stand. Our firm analyzes each element from the first day of representation and builds the defense around the specific weaknesses in the prosecution’s evidence.
First-Degree Robbery Sentence in California — What You Are Facing
The sentence for a first-degree robbery conviction depends on the specific circumstances of the offense:
- Single victim, general first-degree robbery: 3, 4, or 6 years in state prison
- Robbery inside an inhabited structure with multiple victims or committed with two or more accomplices: 3, 6, or 9 years in state prison
- Great bodily injury enhancement under PC 12022.7: 3 to 6 additional years consecutive
- Firearm use under PC 12022.53: 10, 20, or 25 years to life added consecutively depending on whether the firearm was displayed, discharged, or caused injury
- Gang enhancement under PC 186.22: additional consecutive prison term
- Third strike: mandatory 25 years to life
First-degree robbery is a serious violent felony and a strike under California’s Three Strikes law. A single conviction adds a strike to your record that doubles the sentence on any future felony conviction and a third strike triggers 25 years to life. Our firm analyzes Three Strikes implications in every robbery case from the outset and pursues Romero motions to dismiss prior strike allegations where the facts and interests of justice support it.
How Our Firm Defends First-Degree Robbery Charges in Los Angeles
Mistaken Identity: The most common defense in robbery cases. Many robbery arrests in Los Angeles are based on eyewitness identification, surveillance footage, and police field show-ups — all of which have documented reliability problems. Eyewitness memory is affected by stress, lighting, distance, and the speed of the event. Surveillance footage is frequently low resolution. Field show-ups where a witness identifies a single person rather than a lineup are inherently suggestive. Our firm challenges identification evidence through expert testimony, cross-examination of identifying witnesses, and independent investigation of the crime scene and circumstances.
No Force or Fear: Robbery requires proof that force or fear was used. When the alleged taking did not involve force or intimidation the charge may not be robbery at all — it may be theft, which carries dramatically lower sentencing exposure. Our firm challenges the force or fear element directly when the prosecution’s evidence of how the taking occurred is ambiguous or disputed.
Lack of Intent to Permanently Deprive: Robbery requires specific intent to permanently deprive the owner of their property. When the circumstances suggest the defendant intended to borrow or temporarily use the property rather than keep it permanently this element is not satisfied. Our firm builds this defense where the facts support it.
Challenging the First-Degree Circumstance: Even when a robbery occurred the prosecution must prove the specific circumstance that elevates it to first degree. Whether a structure was actually inhabited at the time, whether the victim was actually a driver or passenger in a qualifying vehicle, and whether the ATM transaction was recent enough to trigger the subsection are all factual questions our firm examines and challenges where the evidence does not clearly support the first-degree designation. Reducing a first-degree robbery to second-degree robbery changes the sentence by years and eliminates one strike from the calculation.
